Liberty , Equality and Fraternity are the three main pillars of fundamental rights in India and this is what puts India on the other side of the world. The country where people enjoys the full freedom and sets the best example of democracy around the globe.Recently american supreme court has given permission to same sex marriage and it has become legal in USA after Ireland. The constitution in USA won, because they consider denying same sex marriage as violating rights to equality. Obviously everyone have equal rights to protection and status in society.The people in USA have lived life by there own way and the judicial system also supported them. The decision of supreme court is welcomed by all, but India have not shown much support. The people in India have mixed views towards same sex marriage and no person can fully support the same decision because the conditions in both the nations are not same. India have to learn a lot from USA and amend and implement of some laws there is need to develop well matured thinking in indian society.
Following are the reasons why India could not make same sex marriage legal.
1. According to IPC section 377 any action done against the law of nature is considered as illegal and can be punished up to lifetime imprisonment .
2. Already high court have denied the permission for same sex marriage in 2013 and if further amendments are to be done then parliament can do that.
3.The Indian society will never accept this change.
4. The traditional thinking of Indian population which does not give place for such unlawful act.
I think India should learn from USA and should support the choice of people and they should be given equal status in society. Their emotions and faith are to be respected and the basic fundamental right of equality should be kept alive. The people should be given a fair chance to live their life by their own way.
